Terms of service

These terms govern your use of the Tideline app and this website, both provided by MarketVision AG, Zürich, Switzerland. By using Tideline you accept them. If you do not, please do not use it.

What Tideline is

Tideline is a personal record-keeping tool. It helps you record supplements and symptoms, brings measurements from Apple Health and Oura alongside them, shows patterns inside your own record, and lets you share parts of it with people you choose.

What Tideline is not

Tideline is not a medical device. It is not intended to diagnose, treat, cure, prevent or monitor any disease or condition, and nothing it shows is medical advice. Do not use it to decide whether to start, stop or change a medication, a supplement or any other treatment. Those decisions belong with you and a qualified clinician. If you think you are having a medical emergency, contact your local emergency service.

The patterns Tideline reports are associations inside your own record. An association is not a cause. A factor can appear because something else changed at the same time, because of chance, or because of how you happened to record things. Tideline shows the number of days behind every figure and how sure the record is precisely so that you can weigh it — not so that you can act on it alone.

Your record is yours

You keep ownership of everything you enter. We claim no rights over your record, do not hold a copy, and cannot read it. You are responsible for keeping your device secure and for backing it up if you want the record preserved.

Accuracy

Tideline reports what you and your connected sources tell it. Measurements from Apple Health and Oura are produced by those systems and we do not verify them. Calculations — the load index, bands, adherence, factors and experiment results — are performed as described in the app, but we do not warrant that they are correct, complete or fit for any particular purpose.

Sharing with clinicians and coaches

When you grant someone access you decide what they may see and until when. You are responsible for who you grant access to. Once a person has seen or exported information, we cannot recall it, and revoking access ends future access only. A clinician's or coach's use of what you share is between you and them; Tideline is not a party to that relationship and does not supervise it.

Third-party services

Apple Health and Oura are operated by Apple Inc. and Oura Health Oy respectively, under their own terms. If either changes or withdraws access, features that depend on them may stop working. We are not responsible for those services.

Availability

Tideline is currently in private testing. It is provided as-is, may change substantially, and may be withdrawn. We do not promise uninterrupted availability, and we may discontinue features. Where a change would remove access to your own record, we will give you notice and a way to export it first.

Liability

To the fullest extent permitted by Swiss law, MarketVision AG is not liable for indirect or consequential loss arising from your use of Tideline, and our total liability is limited to the amount you have paid for it in the twelve months before the claim. Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. Your statutory consumer rights are unaffected.

Governing law

These terms are governed by Swiss law. The courts of Zürich have jurisdiction, save where mandatory consumer law gives you the right to bring proceedings where you live.

This is a draft. It describes the intended terms for an app that has not yet been released, and needs review by a qualified lawyer before it is relied upon — particularly the liability, medical-device and consumer-law wording, which differ by market.
